Brighter Super Family & Friends Referral Program Terms and Conditions

These Terms and Conditions ("T & Cs") (together with the documents referred to in them) set out the terms which govern Brighter Super's Family & Friends Referral Program ("Referral Program"). Please read these T & Cs carefully. By participating in our Referral Program, you confirm that you accept and will comply with these T & Cs.

1. ELIGIBILITY AND PARTICIPATION


1.1    Subject to your compliance with these T &Cs, LGIAsuper Trustee ABN 94 085 088 484 ("Trustee") as trustee for LGIAsuper ABN 23 053 121 564 (“Fund”) trading as Brighter Super ("Brighter Super") will provide you with a $100.00 Prezzee voucher if you meet the Referral Program requirements (as in force at that time) in Australia.

1.2    This program commences on 18th November 2020 and closes on 30th June 2024 at 11:59 pm AEST.

1.3    You must be an existing member of the Fund, who has held their membership with the Fund for at least 60 days and holds an accumulation, pension or defined benefit account with a minimum balance of $1,000, to use the Referral Program and you must be a current member of the Fund at the time your friend or family member meets the requirements of the Referral Program.

1.4    The Referral Program is not available to members who are employers (being a director or company secretary) in respect of referrals of their employees.

1.5   You may use the Referral Program by sharing a referral link obtained either by:

  • i. receiving an email from Brighter Super inviting you to participate in the Referral Program; or
  • ii. upon completing a Super Health Check appointment with Brighter Super and being invited to participate in the Referral Program; or
  • iii. sending an email request to Brighter Super for a referral link, through a Super Hub, Toolbox or your Member Online account, to which Brighter Super may elect to provide you with a referral link.

1.6   Where you meet the requirements of the Referral Program you are entitled to a $100.00 Prezzee voucher each time you meet such requirements, up to a maximum of four times. The $100.00 Prezzee voucher will be issued by email to your nominated email address within one month of all requirements of the Referral Program criteria having been met.

1.7   To refer a friend or family member to the Fund you must provide the friend of family member with your referral link and your friend or family member must use your referral link when joining the Fund. Please note you may hold a different product with Brighter Super to what your friend or family member may be eligible for. Accordingly, your friend or family member must consider the Product Disclosure Statement (PDS) to decide whether the product is right for them.

1.8   Upon joining, your friend or family member must: i. consolidate a minimum of $1,000.00 to their account or make one or more contributions so that they have an account balance of at least $1,000.00 within three months of joining the Fund; and ii. remain a member of the Fund for a minimum of sixty days.

1.9   Each new member who joins the Fund using the referring member’s referral link and adheres to the terms of this Referral Program will receive a $100.00 Prezzee voucher.

1.10  All eligible referrals will receive the Prezzee voucher as an eGift Card Voucher sent to their nominated email address by Prezzee directly. Redemption of the Prezzee voucher will managed by Prezzee Pty Ltd ABN 16 602 963 422 ("Prezzee") and governed by their terms and conditions which are available here: https://www.prezzee.com.au/doc/business-terms-of-service/. 1.11  If a referred friend or family member receives multiple referral links from members to join the Fund, only the member whose referral link the friend or family member uses at the time of joining the Fund will be eligible for participation in the Referral Program.

1.12  Brighter Super in no way makes any guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Referral Program.

1.13  Brighter Super in no way makes any guarantees with respect to Prezzee’s performance or the ability to use or claim the Prezzee voucher.

2. PRIVACY


2.1   Brighter Super collects personal information in order to conduct the Referral Program and may, for this purpose, disclose such information to third parties, including, but not limited to agents, contractors, service providers, promotion suppliers and as required. Participation by you and any eligible new member in the Referral Program is conditional on personal information being provided and disclosed. Any personal information provided will be handled in accordance with Brighter Super’s Privacy Policy which can be found here: https://www.brightersuper.com.au/about-us/governance/reports-and-policies/privacy.

2.2   By participating in the Referral Program, all participants (including you, your friend or family member) provide consent for Brighter Super to provide their name and nominated email address to Prezzee and to any other required third parties for the purposes of the Referral Program.

2.3   When you receive the referral link from Brighter Super you will be required to opt into the referral program and expressly consent to your name and nominated email address being provided to Prezzee in accordance with Brighter Super’s Privacy Policy.

3. PROHIBITED USES AND ACTIONS

3.1   You may only use our Referral Program for lawful purposes and in good faith. This means that you must not:

  • i. create more than one account in order to refer yourself;
  • ii. invite others that have created, or may create, duplicate accounts;
  • iii. use alternative contact information to refer yourself or others that have created duplicate accounts;
  • iv. invite members that you do not know personally, if you do so in a way that, in Brighter Super’s opinion, constitutes spam or other undesirable or unsolicited communications;
  • v. invite an existing customer of Brighter Super;
  • vi. invite fictitious persons;
  • vii. do anything that damages Brighter Super’s brand, goodwill or reputation;
  • viii. use the Referral Program in:
  • (a) any way that breaches any applicable local, national or international law; or
  • (b) any way that is unlawful or fraudulent;
  • ix. transmit any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
  • x. otherwise attempt to circumvent this Referral Program.

 

3.2   If you are an employer (being a director or company secretary) you must not refer a person who is your employee.

3.3   You must not share your referral link on any website (including OzBargain, RetailMeNot, Finder or other similar websites) as Brighter Super may, in its absolute discretion, determine you are ineligible for participating in the Referral Program if your referral link has be shared on any website and may refuse to provide the Prezzee voucher. Any person who signs up to become a member of the Fund who has used your referral link to join, where your referral link has been shared on a website, Brighter Super may, in its absolute discretion, determine the new member ineligible for participating in the Referral Program and may refuse to provide the Prezzee voucher.

3.4   Your referral link may be shared through your personal social media accounts privately. Sharing your referral link through your social media platforms is permitted when shared in a way that does not constitute advertising or marketing of your referral link. By using your personal social media accounts, you agree to the terms of use of those social media platforms including their own terms and conditions and privacy policies.

3.5   By providing your referral link to refer a family member or friend to the Fund does not authorise you in any way to offer any advice on behalf of Brighter Super, including in connection with any financial product. You are not authorised to arrange any financial product or service, nor to commit Brighter Super in any way. Nothing in these Terms and Conditions shall result in you being construed as an agent of Brighter Super or the Fund.

3.6   The Referral Program is not available to officers, employees or contractors of Brighter Super or its associated entities.

4. IDENTIFICATION DOCUMENTS

4.1   Brighter Super may require you, your friend or family member to provide identification documents prior to issuing the Prezzee voucher.

4.2   If you, your friend or family member do not provide the requested identification documents, Brighter Super may at its discretion determine that you, your friend or family member are ineligible to receive the Prezzee voucher.

5. ABUSE OF REFERRAL PROGRAM T & Cs

5.1   Brighter Super has the right to refuse to pay you the Prezzee voucher if (in its sole and absolute discretion) it suspects that you have engaged in one or more of the Prohibited Actions set out in Section 3 above, not used the Referral Program in good faith, or have breached any of these T & Cs.

5.2   Brighter Super will determine, in its sole and absolute discretion, whether there has been a breach of these T & Cs. Where a breach has occurred, Brighter Super may take such action as it deems appropriate, including exercising its rights to not reward you with a Prezzee voucher, placing a flag on your Brighter Super account to disallow any further participation in the Referral Program or terminating or suspending the Referral Program.

6. LIMITATION OF LIABILITY

6.1   Neither Brighter Super nor its associated entities accepts any liability whatsoever for any use of the Referral Program which does not comply with this Agreement or for any taxation consequences related to your participation in the Referral Program.

6.2   Nothing in these T & Cs limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under Australian law.

6.3   Except for any liability that cannot by law be excluded, Brighter Super (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Referral Program, including but not limited to:

  • i. any theft, unauthorised access or third party interference;
  • ii. any Prezzee voucher that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of Brighter Super;
  • iii. any variation to the value of the Prezzee voucher to that stated in these T & Cs;
  • iv. any tax liability incurred by the Brighter Super member or friend or family member; and
  • v. taking and/or use of the Prezzee voucher.

7. CHANGES TO THE REFERRAL PROGRAM

7.1   Brighter Super may revise or amend these T & Cs from time to time. Continued participation in the Referral Program will amount to acceptance of the T & Cs as in force at that time.

7.2   Brighter Super reserves the right to without notice, at any time:

  • i. Revise, amend, alter or change the Referral Program; and
  • ii. Discontinue or terminate the Referral Program.

7.3   In the event the Referral Program is discontinued or terminated, Brighter Super will honour the Referral Program for any referrals which met the requirements of the Referral Program prior to the Referral Program discontinuing or terminating.

8. DISPUTE RESOLUTION

8.1   These T & Cs are governed by the law in force in the state of Queensland, Australia. Any dispute arising in connection with the Agreement or these Terms and Conditions, or in connection with Brighter Super, which cannot be resolved by good faith negotiations between the parties, will be referred to mediation.

9. GENERAL

9.1   The information contained in these T & Cs, on Brighter Super’s website and in our emails is general in nature and has been prepared without taking into account your objectives, financial situation or needs. Before making a decision in relation to your super you should read the Brighter Super PDSs, speak to a licensed financial professional and consider if the information is appropriate to you.

9.2   Participants in the Referral Program should seek independent advice in relation to tax implications in respect to participating in the Referral Program and consider your financial objectives and personal circumstances prior to participating in the Referral Program.
